By accessing and using creWHO ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

creWHO is a platform that facilitates connections between crew members and recruiters in the yachting industry. We provide the technology and infrastructure for users to create profiles, post job opportunities, and apply for positions. We do not employ crew members or guarantee employment - we simply provide a platform for others to connect.

3. User Accounts

To access certain features of the Platform, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate and current
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. User Conduct

You agree not to use the Platform to:

  • Post false, misleading, or fraudulent information
  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Transmit any harmful or malicious code
  • Attempt to gain unauthorized access to the Platform
  • Use the Platform for any commercial purpose without authorization

5. Platform Usage

For Recruiters: You are responsible for the content you post and any interactions with other users. You agree to:

  • Provide accurate information in your job postings
  • Comply with all applicable laws and regulations
  • Respect other users and maintain professional conduct
  • Not use the platform for illegal or harmful purposes

For Crew Members: You are responsible for the accuracy of your profile and applications. You agree to provide truthful information about your qualifications and experience.

6. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Platform, to understand our practices regarding the collection, use, and disclosure of your personal information.

7. Intellectual Property

The Platform and its original content, features, and functionality are and will remain the exclusive property of creWHO and its licensors. The Platform is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Platform Disclaimers

creWHO is NOT an employment agency or recruitment firm. We are a technology platform that facilitates connections between users. We do not:

  • Employ crew members or guarantee employment
  • Set wages, working conditions, or employment terms
  • Handle employment contracts or legal obligations
  • Provide employment advice or legal guidance
  • Guarantee the accuracy of user-generated content
  • Vouch for the reliability or legitimacy of other users

9. Payment Terms

Current Service: creWHO is currently provided free of charge to all users. We reserve the right to introduce paid features, premium services, or subscription plans in the future. Any paid features will be clearly marked and subject to separate terms and conditions. Users will be notified in advance of any changes to our pricing structure.

10. User Responsibility

All users are responsible for their own agreements and interactions:

  • Crew Members: You are responsible for verifying job details, negotiating terms, and ensuring compliance with all applicable laws and regulations
  • Recruiters: You are responsible for accurate job postings, fair hiring practices, and compliance with employment laws
  • Both Parties: Any employment agreements, contracts, or arrangements are solely between you and other users
  • Due Diligence: Always verify information, check references, and conduct appropriate background checks

creWHO is not involved in, responsible for, or liable for any disputes, agreements, or arrangements between users.

11. Content Guidelines

Job postings and user content must comply with these guidelines:

  • Accurate Information: All job postings must contain truthful, complete, and up-to-date information
  • Professional Conduct: Maintain respectful and professional communication
  • Legal Compliance: All content must comply with applicable laws and regulations
  • No Discrimination: Job postings must not discriminate based on race, gender, age, religion, or other protected characteristics
  • Appropriate Content: No offensive, illegal, or inappropriate material
  • No Spam: No duplicate, misleading, or spam content

We reserve the right to remove any content that violates these guidelines or our Terms of Service.

12. Dispute Resolution

Disputes between users:

  • creWHO is not responsible for resolving disputes between users
  • Users are encouraged to resolve issues directly and professionally
  • For serious violations, users can report issues to us for review
  • We may suspend or remove accounts that violate our Terms of Service

Disputes with creWHO:

  • Any disputes with creWHO will be resolved through binding arbitration
  • You waive the right to participate in class action lawsuits
  • These Terms are governed by the laws of the jurisdiction where creWHO operates

13. Limitation of Liability

In no event shall creWHO, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Platform.

14. Termination

We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
